Boarding Agreement

Sundown Kennels agrees to exercise due and reasonable care in the boarding of all pets and maintain the premises in a clean and sanitary condition.
Pet owner, hereafter referred to as “Owner,” agrees to pay all costs and charges for boarding rate and charges for special services requested and all veterinary costs for pet during the time said pet is in the care of Sundown Kennels.  By signing this contract and leaving the pet with Sundown Kennels, the Owner certifies to the accuracy of all information given about said pet.
All animals admitted must be current on vaccinations and must be free of external parasites.  Any animals found to have fleas or ticks will be treated at the Owner's expense.  Any vaccinations needed upon arrival will be given and the Owner is responsible for charges. 
If a medical problem is discovered, an agent of Sundown Kennels shall attempt to contact the Owner or emergency contact to discuss the problem and determine the course of action to be taken.  If the Owner or emergency contact cannot be reached, the veterinarian on call has permission to take the steps necessary to diagnose and treat, in accordance with current medical standards.  In case of emergency, measures to preserve and stabilize vital functions shall be taken immediately. The Owner/agent is personally liable for all fees for lodging, veterinary services and any other expenses incurred while the animal is boarded.
All charges incurred by the Owner shall be payable upon pick up. Sundown Kennels shall have, and is hereby granted a lien on the pet for any and all unpaid charges resulting from boarding the pet at Sundown Kennels.  The Owner hereby agrees that in the event the boarding charges are not paid when due in accordance with this contract, Sundown Kennels may exercise its lien rights upon ten days written notice given by Sundown Kennels to Owner by certified mail sent to address on client card.  Sundown Kennels may dispose of pet for any and all unpaid charges at private or public sale, in the sole discretion of Sundown Kennels, and the Owner specifically waives all statutory or legal rights to the contrary.  If such sale shall not secure a price adequate to pay such costs of board or other delinquent charges, plus cost of sale, the Owner shall be liable to Sundown Kennels for the difference.  All monies realized by Sundown Kennels at such sale, over and above the charges due and costs of sale, shall be paid by Sundown Kennels to Owner.
Sundown Kennels shall exercise all reasonable precautions against injury, escape, accidents or death of pet.  It is expressly agreed by the Owner and Sundown Kennels that Sundown Kennel's liability shall in no event exceed the lesser of the current value of a pet of the same species and breed or the sum of $200 per animal boarded.  The Owner further agrees to be solely responsible for any and all acts or behavior of said pet while in the care of Sundown Kennels and needs to make Sundown Kennels aware of any personality problems the pet may have.
Any controversy or claim arising out of or relating to this contract, or the breach thereof, or as the result of any claim or controversy involving the alleged negligence by any party to this contract, shall be settled by arbitration in accordance with the rules of the American Arbitration Association and judgment upon the award rendered by the arbitrator may be entered in any Court having jurisdiction thereof.  The arbitrator shall as part of his or her award determine an award to the prevailing party of the costs of such arbitration and reasonable attorney's fees of the prevailing party.
